One Settlement at a Time.

The Procedures That Were Involved

A court application, typically on Form A Notice of (Intention to Proceed With) an Application for a Financial Order or Other Financial Remedy, is made when mediation and discussions have failed. The application is typically submitted online, after which the court notifies the parties and establishes a timeline:

  • Phase 1: Pre-Settlement & Agreement
  • Phase 2: Receipt and Clearing of Funds
  • Phase 3: Fund Distribution (Disbursement)
  • Phase 4: Post-Settlement

Orders of consent

While consent orders are issued with the court’s approval, nuptial, civil partnership, or separation agreements cannot remove the court’s authority.

Just because parties have reached an agreement does not mean that the court will automatically adopt consent orders. Using the criteria outlined in Schedule 5, Part 5 of the Civil Partnership Act of 2004 and Section 25 of the Matrimonial Causes Act of 1973, the court determines whether the proposed orders are a just and equitable conclusion.

If the required documentation is included with the application, the court can issue consent orders without the parties or their attorneys being present.
